Sonam Wangchuk's Wife Moves Delhi High Court, Alleges 'Illegal Detention' at Safdarjung Hospital

Social activist Sonam Wangchuk's wife, Gitanjali Angmo, has approached the Delhi High Court, seeking her husband's transfer from Safdarjung Hospital to a private medical facility. In her petition, she alleges that Wangchuk is being kept under "illegal detention" at the government-run hospital and is being denied access to his lawyers and personal doctors.

According to the petition, Wangchuk has not been allowed to meet his legal counsel or his own medical team while undergoing treatment at Safdarjung Hospital. Angmo argued that this amounts to an unconstitutional restriction on his personal liberty and requested the court to declare the detention a violation of Article 21 of the Constitution of India, which guarantees the right to life and personal liberty. She has also sought immediate orders for his release from what she describes as unlawful confinement.

What Is the Controversy?

The legal challenge comes after Sonam Wangchuk was removed from the protest site at Jantar Mantar in New Delhi. According to the Delhi Police, Wangchuk's health deteriorated significantly due to his ongoing hunger strike. Police officials stated that, considering his severe physical weakness, he was admitted to Safdarjung Hospital on July 18 for medical treatment.

However, Gitanjali Angmo disputes the circumstances surrounding his hospitalization. She claims that her husband is effectively being held against his will in the government hospital and has requested that he be shifted to a private hospital where he can receive treatment from doctors of his choice and meet his legal representatives freely.

The Delhi High Court is expected to hear the matter and decide whether Wangchuk's continued stay at Safdarjung Hospital constitutes unlawful detention or is a medically necessary arrangement.
